The 2014 assessments have been established at $79.86 per parcel (which is a 10% increase from last year), in addition to the standard assessment of $5.00 per acre.



Desert Vistas was once a single piece of land, nearly a square mile in size, known affectionately as the “Pickle Patch”, because the prior owners were the Vlasic’s of the pickle company family. That ground became the Unsubdivided Land Development that was established in May 1999 through the that certain Record of Land Survey Sunrise Desert Vistas recorded on 05/27/1999 at Book 503, Page 13, and indexed as Instrument No. of the Official Records of Maricopa County, Arizona (the“”), and consists of 16“” that run from roughly 38 to 40 acres each. As acceptable legal shorthand, each Original Parcel is referred to as “Lot __, SUNRISE DESERT VISTAS, MCR 503-13”. became the Unsubdivided Land Development that was established in May 1999 through the that certain Record of Land Survey Sunrise Desert Vistas recorded on 05/27/1999 at Book 503, Page 13, and indexed as Instrument No. of the Official Records of Maricopa County, Arizona (the“”), and consists of 16“” that run from roughly 38 to 40 acres each. As acceptable legal shorthand, each Original Parcel is referred to as “Lot __, SUNRISE DESERT VISTAS, MCR 503-13”.

 

SUNRISE DESERT VISTAS – A BEAUTIFUL DESERT
"UNSUBDIVISION"
The words “unsubdivided” or “unsubdivision” are used in the Arizona statutes for formal subdivisions in which each of the parcels created is at least 36 acres in size. So we will refer to all of the ground that falls within those 16 Original Parcels as either “Sunrise Desert Vistas” or the “Unsubdivision"; (perhaps you remember 7-Up’s “uncola” campaign).
The entire Unsubdivision falls within Section 18, Township 5 North, Range 6 East of the Gila and Salt River Base and Meridian, Maricopa County, Arizona, which is bounded by the alignments for 136th & 144th Streets on the west and east, and Lone Mountain Road and Dove Valley Road on the south and north, and is located 2 miles North of Rio Verde Drive, in a presently unincorporated area of Maricopa County, Arizona.


A section of land is usually a full square mile of land, but Section 18 is a “closing section” that lies along the west edge of the 36 square mile township (Township 5 North, Range 6 East), so the Government Land Office (forerunner to the BLM) specially surveyed the western portion of the section into four “GLO Lots” (simply called Lots 1, 2 3 & 4) that may run 40+/- acres each. In addition, 55 feet of rights of way along both the west and east sides of the section were previously dedicated to serve as half widths for 136th and 144th Streets, so that ground was never included in the “Unsubivision” in the first place.

As a consequence: (1) the Unsubdivision is consists of 625.45 acres of land, nearly all of the land in the Section, but not the full 640 acres of a full square mile; (2) many of the Original Parcels are not a full 40 acres in size;and (3) many of those Original Parcels actually include portions of the following several miles of roadway that are located within the Subdivision and maintained by SDVPOA (the “Roadways”):

(a.) the north half street width for Lone Mountain Road and the south half street width for Dove Valley Road, (i.e. the portion of each street that falls within the section/subdivision), which are shown on the Plat as having a 55 foot wide width (half street); and

(b.) 6 internal roadways that consist of (i.) 140th Street and Ashler Hills Drive, the two “Half-Mile Streets” that run through the center of the section and show on the Plat as having an 80 foot total width; (ii.) 138th and 142nd Streets, Ranch Road and Aloe Vera Drive, the four “Quarter-Mile Streets” that run half way between the foregoing Mile and Half-Mile Streets and all show on the Plat as having a 60 foot total width.

The original sale of the original parcels of land in any unsubdivision requires delivery to the buyers of a public report (sometimes called a subdivision report) that is prepared by the AZ Dept of Real Estate. CC&Rs and ASSOCIATION or “SDVPOA”
Whether or not the original parcels in any “unsubdivision” may be further divided by the first purchasers or successive owners depends on both the “public law” (the zoning and lot split-subdivision laws) and any “private law” that may exist through private contractual restrictions that bind the ground, generally in the form of either specific deed restrictions or separate recorded declarations that are called“Covenants, Conditions & Restrictions” or“CC&Rs”.

The developer of Sunrise Desert Vistas, Brookfield Desert Realty, recorded such restrictions against the entire Unsubdivision through those certain Declaration of Covenants, Conditions and Restrictions Affecting Real Property recorded on 05/27/1999 immediately after the Plat, at Instrument No. 99-0506142 of the Official Records of Maricopa County Recorder, (the“CC&Rs”). Those original CC&Rs are also available on this website, and have never been amended.

At the same time as it recorded the Plat and the CC&Rs, the developer also created SUNRISE DESERT VISTAS PROPERTY OWNERS ASSOCIATION, INC. (the“Association” or“SDVPOA”) as the non-profit corporation called for in the CC&Rs by filing Articles of Incorporation with the Arizona Corporation Commission on 05/24/1999, and adopting the parallel By-Laws of the Association.
